Rep. Sheila Cherfilus-McCormick (D-Fla.) resigned from Congress on Tuesday. Her departure came just before the House Ethics Committee was set to recommend a punishment for her. The committee had found her guilty last month of funneling $5 million in COVID relief funds to her congressional campaign.

Cherfilus-McCormick was likely on the cusp of being expelled. Even fellow House Democrats reportedly said they could no longer countenance her continued presence in Congress. Many lawmakers expected the committee to float a severe penalty.

The $5 million in misdirected pandemic aid represents the most notable charge against her. She has denied any wrongdoing. The resignation marks the third departure from a House member this month, following Reps. Eric Swalwell (D-Calif.) and Tony Gonzales (R-Texas).

Her exit creates an immediate vacancy in Florida's 20th congressional district. A special election will be required to fill the seat. The timing removes a contentious ethics vote from the House floor.

In a statement, Cherfilus-McCormick claimed the Ethics Committee did not give her a 'fair process.' She said her ongoing criminal trial prevented her from defending herself and that she chose to step away to focus on fighting for her constituents.
